Swingly, Inc. ("Swingly," "we," "us," or "our"), a Delaware corporation, operates the Swingly platform, including the website at swingly.club, the Swingly mobile application, and all related services (collectively, the "Service"). This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you use our Service.
By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.
1. Information We Collect
1.1 Information You Provide
- Account Information: When you create an account, we collect your name, email address, and password. Instructors may also provide a display name, handle, profile photo, bio, and specialties.
- Profile Data: Learners may provide optional information such as handicap, home course, experience level, and learning goals.
- Payment Information: Payment card details are collected and processed by Stripe, Inc. ("Stripe"), our third-party payment processor. We do not store full card numbers on our servers. We retain Stripe customer IDs and transaction metadata (such as transaction type, content identifier, instructor identifier, and amount) necessary to manage subscriptions, purchases, tips, and payouts, to reconcile earnings, and to handle refunds and chargebacks.
- Instructor Identity Verification (Stripe Connect KYC): If you apply to become an Instructor, Stripe performs identity verification ("Know Your Customer" or "KYC" checks) directly. As part of that process, Stripe collects information that may include your legal name, date of birth, residential address, taxpayer identification number (such as a Social Security Number or Employer Identification Number), bank account information, and, in some cases, a government-issued photo identification. This information is collected and stored by Stripe under Stripe's Connected Account Agreement and Stripe's privacy policy, not by Swingly. Swingly receives only a limited subset of identity data needed to operate the Service — including a Stripe-issued Connected Account identifier and onboarding status flags (such as whether you are approved to accept charges and receive payouts) — and does not see or store your full taxpayer identification number, bank account number, or identity documents.
- Content: Instructors upload video content, descriptions, and metadata. Learners may submit messages to our AI features, bookmarks, reactions, and reviews.
- Communications: When you contact us at support@swingly.club, we retain your correspondence to respond and improve our Service.
1.2 Information Collected Automatically
- Usage Data: We collect information about how you interact with the Service, including pages visited, videos watched, watch duration, features used, and navigation paths.
- Device Information: We collect device type, operating system, browser type, screen resolution, and unique device identifiers.
- Log Data: Our servers automatically record information including your IP address, access times, referring URLs, and pages requested.
1.3 Information from Third Parties
- Payment Processor: Stripe provides us with transaction confirmations, payment method types, fraud indicators, Connected Account onboarding and capability status (such as whether an Instructor is approved to accept charges or receive payouts), and chargeback and dispute notifications.
- Video Infrastructure: Mux, Inc. provides video playback analytics and processing status information.
2. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the Service, including personalized lesson recommendations and AI-powered coaching features.
- Process payments, subscriptions, pay-per-view purchases, tips, and instructor payouts.
- Send transactional communications such as account verification, purchase confirmations, and subscription updates.
- Provide customer support and respond to inquiries.
- Monitor and analyze trends, usage, and activity to improve user experience.
- Detect, investigate, and prevent fraudulent transactions, abuse, and other harmful activities.
- Comply with legal obligations and enforce our Terms of Service.
3. How We Share Your Information
We do not sell your personal information. We share information only in the following circumstances:
- Service Providers: We share information with third-party vendors who assist in operating our Service, including Stripe (payments), Mux (video hosting and streaming), Vercel (hosting), Neon (database), and Resend (email delivery). These providers are contractually obligated to use your information only to provide services to us.
- Instructors: When you subscribe to, purchase from, or tip an instructor, they may see your name and relevant transaction details. Instructors do not receive your email address, payment method, or other private account information.
- Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect the rights, property, or safety of Swingly, our users, or others.
- Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as a business asset. We will notify you of any such change in ownership or use of your personal information.
4. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service. We retain transaction records as required for financial reporting, tax compliance, and dispute resolution. When you delete your account, we will delete or anonymize your personal information within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or enforcing agreements).
5. Data Security
We implement industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS), secure authentication, and access controls. Payment information is processed and stored by Stripe in PCI DSS-compliant infrastructure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
6. Your Rights and Choices
- Access and Correction: You may access and update your account information through your profile settings at any time.
- Account Deletion: You may request deletion of your account by contacting us at support@swingly.club. Deletion will be completed within 30 days.
- Email Preferences: You may manage notification preferences in your account settings. Transactional emails (purchase confirmations, security alerts) cannot be opted out of while your account is active.
- Data Portability: You may request a copy of your personal data in a machine-readable format by contacting us at support@swingly.club.
7. California Privacy Rights
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and share, the right to request deletion of your personal information, and the right to opt out of the sale of personal information. 8. Children's Privacy
The Service is not directed to individuals under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly. 9. International Users
The Service is operated from the United States. If you are accessing the Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to such transfers.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised policy.
